HOA CONTACT INFORMATION AND DOCUMENTS

HOA Directory ( Texas Comptroller of Public Accounts ) - Search by Name, Tax ID, or Filed number. Homeowners can enter the community's name or subdivision to find the association’s contact information, list of board members, and other relevant association information. 


TREC has created a website specifically dedicated to HOA management certificates, which is available at, www.hoa.texas.gov. This website provides both a means for HOAs to upload their management certificates to a central database and a means by which the public can search for and access the management certificates after they have been uploaded.

 PLEASE NOTE: While TREC is responsible for maintaining this centralized database and website, TREC does not have regulatory authority over HOAs. This means that TREC does not license or register HOAs and TREC does not have enforcement jurisdiction over HOA.  

HOAs Fees (Cost)

The Good news is the cost of obtaining a resale certificate in Texas is capped at $375. 

And updated resale certificates (at $75). 


Since it is the seller’s responsibility to provide it, the seller typically pays this expense at the time it is ordered.

 How HOA Laws are Changing in Texas 


HOA management companies usually expect payment upfront before they will process an order. By Texas law, they have 10 business days (usually 14 calendar days) to deliver the resale certificate and documents once the order is placed and payment is received.


There is no restriction on rush or demand fees. If the requested information is due before 10 business days, the additional expedited or demand fees range can range from $100 to $350. 


To avoid rush fees, allow adequate time in the contract for these documents to be delivered.


The HOA may also charge transfer fees, processing fees, account closure fees, or fees for items like common area keys. These are disclosed in the resale package.

According to the Community Associations Institute, an estimated 5.6 million Texans lived in a community association in 2018. So chances are You will likely live in an HOA.

 If your home is part of an HOA, you'll need to give the buyer documentation on the covenants, codes, restrictions, financial history, required fees, and approval process. 

 RESALE CERTIFICATE FOR PROPERTY SUBJECT TO MANDATORY MEMBERSHIP IN A PROPERTY OWNERS' ASSOCIATION (TREC Form)

The Three Types of Community Associations

Condominium Associations:  Members own their units and jointly manage and own the common spaces with other association members.


Homeowners’ Associations: Members own the residence and the property it sits on, and the association owns and manages the common spaces.


Property owners’ Association: Homeowners, business owners, and property managers can be part of the association. POAs may include HOAs and COAs.


No state agency governs community associations in Texas, although they may rely on the Community Associations Institute or Texas Community Association Advocates for standards and lobbying protection when the state legislature meets.


Homeowners can call the Greater Houston Chapter of the Community Associations Institute hotline for a second opinion on covenants and restrictions at 832-251-1874.
